9. Public Data Collection Legal Basis
PropAPIS collects and processes aggregated real estate data from publicly available sources in accordance with established legal precedents:
Legal Foundation
Our data collection practices are supported by international case law and statutory protections:
- U.S. Law: In hiQ Labs v. LinkedIn, the Ninth Circuit ruled that accessing public websites does not violate the Computer Fraud and Abuse Act (CFAA).
- Copyright Law: Under Feist v. Rural, facts are not copyrightable. We extract factual information, not creative expression.
- EU Law: The Database Directive does not prohibit lawful extraction of non-substantial parts of public databases.
Public Data Processing
We collect data that is publicly available on the internet—accessible without login, subscription, or circumvention of technical barriers. This includes:
- Real estate listings and market data
- Property information and valuations
- Market trends and analytics
- Public directory information
No Personal Data Collection
Our systems are designed to process non-personal, factual, and aggregated public data. We do not:

10. Clients' Responsibilities
If you use PropAPIS data in a way that involves processing third-party personal data (e.g., combining it with your own systems), you are solely responsible for:
- Ensuring appropriate legal basis for such processing,
- Complying with applicable privacy laws,
- Providing adequate notices and obtaining consents from your own users.
PropAPIS disclaims all liability for privacy obligations arising from your downstream use of the data.
11. Response to Legal Inquiries
We assess legitimate legal inquiries regarding data collection practices on a case-by-case basis. We do not guarantee the cessation of lawful data collection unless required by applicable law, judicial decision, or formal legal obligation.
Our commitment is to remain compliant while defending lawful access to public information.
