    Welcome to PropAPIS. By accessing or using our services, you agree to be bound by the following Terms of Service ("Terms"). If you do not agree, do not access or use the platform.

    1. Overview

    PropAPIS provides access to transformed and aggregated real estate market data for business intelligence purposes. Our services include analytics, data dashboards, and structured insights generated from publicly available real estate sources. We do not provide original or unaltered data from third-party websites.

    2. Legal Basis for Data Collection

    Our data collection practices are founded on established legal precedents and statutory protections:

    Public Data Access Rights

    • U.S. Law: In hiQ Labs v. LinkedIn, the Ninth Circuit ruled that accessing public websites does not violate the Computer Fraud and Abuse Act (CFAA).
    • Copyright Law: Under Feist v. Rural, facts are not copyrightable. We extract factual information, not creative expression.
    • EU Law: The Database Directive does not prohibit lawful extraction of non-substantial parts of public databases.

    No Unauthorized Access

    We do not engage in unauthorized access, hacking, or circumvention of security measures. Our systems respect authentication protocols and do not interact with private or login-protected content.

    Terms of Service Compliance

    Courts have held that passive browsing of publicly available websites without affirmative agreement to Terms of Service (TOS) generally does not constitute a binding contract. Unless users explicitly accept TOS via mechanisms like "clickwrap," merely accessing a website does not create enforceable contractual obligations in most jurisdictions.

    3. License and Permitted Use

    PropAPIS grants you a limited, non-exclusive, non-transferable, revocable license to use the services and access data solely for your internal business operations.

    You may not, without express written permission:

    • Resell, sublicense, publish, or redistribute PropAPIS data to third parties.
    • Use the services to create or enhance a competing product or database.
    • Use the services or data for training AI, machine learning models, or LLMs.
    • Reverse-engineer, extract, or reproduce data structures or algorithms used in the PropAPIS platform.

    4. Ownership and Intellectual Property

    All rights, title, and interest in the PropAPIS platform, including software, tools, analytics, and reworked data, are and shall remain the exclusive property of PropAPIS.

    PropAPIS does not claim ownership of any underlying third-party data originally collected from public or private real estate sources. You acknowledge that such data may be subject to third-party intellectual property rights and/or terms of service of their respective platforms.

    You are solely responsible for ensuring that your use of PropAPIS data complies with any third-party rights or obligations.

    5. Disclaimer and Limitation of Liability

    PropAPIS provides its services and data "AS IS" and "AS AVAILABLE", without warranties of any kind.

    We make no representations or guarantees regarding the accuracy, completeness, reliability, legality, or availability of the data, including any information derived from third-party real estate sources.

    To the fullest extent permitted by law:

    • We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.
    • We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits or loss of data.
    • Our total liability to you shall not exceed the amount paid by you for services in the preceding six (6) months.

    6. User Responsibilities

    You agree to:

    • Use the services in compliance with all applicable laws, regulations, and third-party rights.
    • Not use PropAPIS to scrape, collect, or aggregate data from prohibited real estate sources.
    • Not attempt to bypass, disable, or interfere with any security or access controls.
    • Maintain confidentiality of any access credentials and account data.
    • Comply with real estate platform terms of service when using our data parsing services.

    7. Indemnification

    You agree to indemnify, defend, and hold harmless PropAPIS, its officers, directors, affiliates, and agents from and against any claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or related to:

    • Your use of the services,
    • Your violation of these Terms,
    • Any data you process, store, or distribute using PropAPIS,
    • Any violation of third-party intellectual property or data rights by you.

    8. Privacy and Data Protection

    Our Privacy Policy governs how we collect, use, and protect your personal data. You are solely responsible for ensuring that your own use of any PropAPIS data complies with applicable privacy laws, including but not limited to GDPR and CCPA.

    Note: PropAPIS makes commercially reasonable efforts to anonymize real estate data, but we do not guarantee the absence of personal data in third-party sources.

    9. Lawful Use of Collected Data

    Collected data is used solely for legitimate purposes such as:

    • Market and economic research
    • Public analysis and benchmarking
    • Technology and AI development
    • Directory aggregation
    • Academic and journalistic research

    We do not sell raw scraped data, but rather provide structured and compliant analytical access.

    10. Response to Legal Notices

    We assess legitimate legal inquiries regarding data collection practices on a case-by-case basis. We do not guarantee the cessation of lawful data collection unless required by applicable law, judicial decision, or formal legal obligation.

    Our commitment is to remain compliant while defending lawful access to public information.

    11. Modifications

    We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Your continued use of the services after such updates constitutes acceptance of the new Terms.

    12. Governing Law and Dispute Resolution

    These Terms are governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to conflict of law principles. Any disputes shall be resolved via binding arbitration in the appropriate venue.
